Federal Communications Commission extends submission deadline for Equal Employment Opportunity audit responses

The Federal Communications Commission (FCC) has announced an extension for responses to Equal Employment Opportunity (EEO) data requests from TV and radio stations. The new deadline is now October 17, 2025.

The decision to extend the deadline and the changes in the data collection process have been coordinated with the FCC's Media Bureau. In a move aimed at easing the burden on stations, the FCC has waived the requirement for privacy and confidential business information to be publicly disclosed in the responses to the audit data inquiries.

Instead of uploading the responses to a station's Online Public Inspection File (OPIF), stations are now instructed to submit their responses via email to [email protected]. For certain audit data inquiries, responses to questions 2(b)(vi)(a-b), (vii-viii) should be submitted separately via email.

It's important to note that stations with fewer than five full-time employees (30 hours a week or more) are exempt from responding to the Inquiries. Section 73.2080(e) of the Rules defines employees regularly assigned to work 30 hours a week or more as full-time employees for the purposes of the EEO audit.

The FCC's Enforcement Bureau issued audit letters to a randomly selected group of TV and radio stations in August. The list of radio and television stations selected for the 2025 audit, along with the text of the Aug. 8 audit letter, is available online.

The Equal Employment Opportunity data requests are part of the annual audits conducted by the FCC's Enforcement Bureau. Approximately five percent of all radio and television stations are selected each year for Equal Employment Opportunity audits.

Respondents are not required to include advertising contracts in response to the Inquiries. The FCC has provided additional guidance for the data collection process of the EEO audit, and the information about the Equal Employment Opportunity data requests, including the list of selected stations and the text of the Aug. 8 audit letter, can be found online.

The email submission should include a statement indicating that the remaining audit data was uploaded to a station's OPIF. Section 1.3 of the Commission's rules has been referenced as the basis for waiving the requirement for responses to be uploaded to a station's OPIF.

There is no available information about which radio and television stations were selected by the FCC for EEO audits in 2025, nor the deadlines for responses to the audit inquiry letters from August 2025. The FCC's Equal Employment Opportunity data requests for the year 2025 are issued by the Federal Communications Commission's Enforcement Bureau.
