The Alternative for Germany (AfD) is seeking to make members of the federal government accountable for mismanaging public funds, according to a bill proposal up for discussion in the Bundestag later this week. This initiative, if passed, could introduce liability for breach of duty among federal ministers.

Citing numerous instances of state decisions leading to significant financial losses for taxpayers, the AfD views this bill as a chance to keep ministers in check. The cases of former Health Minister Jens Spahn's PPE procurement fiasco and the tollgate scandal involving ex-Transport Ministers Alexander Dobrindt and Andreas Scheuer serve as examples.

The AfD asserts that these high-ranking officials are responsible for the damages due to their "ideologically driven reasons." Section 7 of the Federal Ministers Act would be amended to hold ministers accountable for any breach of duty, requiring them to compensate the Federal Republic of Germany for any incurred damages.

"Plucking from the Populism Tree"

The Green Party opposes the proposal, stating that it suggests immunity for ministers that does not exist. Lukas Benner, a member of the legal committee, believes that federal ministers are already criminally liable for intentional fraud or immoral harm to the treasury, albeit with high legal hurdles. He sees the AfD's proposal as a cheap grab at populism.

But is it just populism, or is there more to it? Some within the AfD may hope for a form of "revenge justice" should they gain control of the government, as suggested by the party's categorization as a secure right-wing extremist by the Federal Office for the Protection of the Constitution.

Brandner Emphasizes Judicial Independence

AfD politician Stephan Brandner dismisses concerns of potential misuse, arguing that the courts, not a succeeding government, would make the decision on civil liability. He trusts the rule of law, particularly in cases involving independent prosecution.

The bill, reportedly modeled after Bavaria's Ministerial Act, has never actually been put into practice. However, its implementation could prove difficult due to the challenge of demonstrating culpability, as seen in the case of Jens Spahn's PPE procurement.

Despite the lack of plans to hold party leaders responsible for mismanaged funds, the AfD has been proactive in addressing potential legal issues. In April, the party precautionarily deposited 2.35 million euros with the Bundestag administration due to fears of a fine following a potentially illegal party donation.
