Extended Deadline for Submitting Responses to FCC's EEO Audit
The Federal Communications Commission (FCC) has announced an extension for responses to the Equal Employment Opportunity (EEO) data request for the 2025 audit. Originally set for September 22, 2025, the deadline has been pushed back to October 17, 2025.
This extension applies to a randomly selected group of TV and radio stations, as part of the annual EEO audits conducted by the FCC's Enforcement Bureau. The audits seek data related to Equal Employment Opportunity, and the audit letters were issued in August.
In a notice, the FCC stated that the deadline extension is based on Section 1.3 of the Commission's rules. The deadline for responses to certain EEO audit data being uploaded to a station's OPIF (Online Public Inspection File) has also been waived. Responses to specific EEO audit questions should instead be submitted via email to [email protected].
The FCC further clarified that privacy and confidential business information will be protected from public disclosure. Stations and their related station employment units (SEUs) are required to submit their last two years of EEO Annual Public File reports by the new deadline.
Notably, radio and TV SEUs with five or more full-time employees located in specific areas, including Alaska, American Samoa, Florida, Guam, Hawaii, Iowa, Missouri, Northern Mariana Islands, Oregon, Puerto Rico, U.S. Virgin Islands, and Washington, must prepare and upload their Annual EEO Public File Report by October 1, 2025.
The list of radio and television stations selected for the 2025 EEO audit, along with the text of the Aug. 8 audit letter, is available online. Each year, approximately 5% of all radio and television stations are selected for EEO audits. The FCC has specified that station employment units with fewer than five full-time employees are exempt from responding to certain EEO audit questions.
Additionally, the FCC has stated that respondents are not required to include advertising contracts in response to the EEO audit questions. The section of the Rules defining employees regularly assigned to work 30 hours a week or more is 73.2080(e).
The FCC's EEO audits are an essential part of ensuring compliance with equal employment opportunity laws in the broadcast industry. The deadline for responses to the EEO data request for the 2025 audit remains October 17, 2025.
