Germany's Federal Constitutional Court Candidate Withdraws Amid Controversy
Frauke Brosius-Gersdorf, the Social Democratic Party's (SPD) nominee for the Federal Constitutional Court, has withdrawn her candidacy following strong opposition from a faction within the center-right CDU/CSU parliamentary group.
The Union faction had "clearly signaled in the last weeks and days that [Brosius-Gersdorf's] election is excluded." This opposition, primarily due to her progressive political stances, including advocacy for late-term abortion rights and support for banning the far-right AfD party, as well as allegations of plagiarism regarding her 1997 doctoral dissertation, posed a significant hurdle for Brosius-Gersdorf's election.
Brosius-Gersdorf, a polarizing figure due to her views, prioritized protecting the coalition and the other nominees by withdrawing. She cited the opposition and the risk of the meltdown of the CDU-SPD coalition as reasons for her withdrawal. Her decision was aimed at preventing political destabilization and protecting the overall judicial appointment agreement.
Jens Spahn, chairman of the Union faction, paid respect to Brosius-Gersdorf's decision and condemned derogatory and insulting criticism directed at her. Brosius-Gersdorf, who was undoubtedly an impeccable jurist according to Thorsten Frei, was unable to gain the necessary two-thirds majority in parliament. The SPD deeply regretted her withdrawal and announced a new proposal. The necessary two-thirds majority requires "a high degree of acceptance," which was not achievable for Brosius-Gersdorf.
