In a significant move, the state parliament in Saarbrücken has approved the first reading of changes to the Saarland constitution. This amendment is part of a broader "resilience package" aimed at making the constitution more robust and countering enemies of democracy.
The initiative to amend the Saarland constitutional preamble was taken by the parliamentary groups of the ruling SPD and the opposition CDU in the Saarland state parliament. The SPD, led by Ulrich Commerçon, and the CDU, led by Stephan Toscani, both supported the constitutional change. Together, these factions hold a majority of seats in the Saarbrücken Landtag, with 48 of the 51 seats.
The other constitutional changes aim to guarantee special protection for Jewish life and secure the Constitutional Court. These changes, along with the preamble amendment, are also part of the "resilience package".
The preamble of the Saarland constitution, prior to the recent changes, did not exist. In the future, it will include a declaration of commitment to intercultural understanding and cross-border cooperation. Additionally, the preamble will now recognise the Franco-German friendship as a political goal.
The AfD holds three seats in the Saarbrücken Landtag, but they were not involved in the decision-making process for these constitutional changes. The identity of the "enemies of democracy" that the changes aim to counter remains unspecified.
The constitutional changes, having been approved in the first reading, will now move to the second and third readings for further discussion and approval before they can become law. This marks a significant step forward in the evolution of the Saarland constitution, which has been in effect since the state's accession to the Federal Republic of Germany on January 1, 1957.
