Dispute over Corona aid - Part of the entrepreneur wins - Entrepreneurs Win: Court Rules Against Repaying Corona Emergency Aid

The Administrative Court of Appeals of Baden-Württemberg has ruled in favor of entrepreneurs in six cases involving the repayment of Corona emergency aid. Among the winners is hairdresser Holger Schier from Heidenheim an der Brenz, who received 10,424 euros. The court's decisions are not yet final, and reasons are expected in November.

The court rejected appeals from L-Bank against four rulings by various administrative courts. These rulings, along with the one involving a winemaker from Freiburg, set precedents for hundreds of other stayed proceedings. Entrepreneurs in these six cases do not have to repay the emergency funds they received during the pandemic.

The court's decision in favor of the state in a driving school operator case was overturned. This ruling, along with the others, has significant implications for the approximately 1,400 lawsuits currently pending against repayment demands, according to L-Bank.

The Administrative Court of Appeals of Baden-Württemberg's rulings in these six cases have provided relief for entrepreneurs who received Corona emergency aid. While the decisions are not yet final, they offer hope that many others may also avoid repaying the funds they relied on during the pandemic.
