Emmason explains the reason behind KWAM1's absence from court, declared by the NCAA
The Nigerian Civil Aviation Authority (NCAA) has found itself at the centre of a controversy following the handling of two high-profile cases involving unruly passengers on Nigerian airlines.
In one case, Comfort Emmanson, a passenger on Ibom Air, was charged in court for alleged unruly behavior after a violent altercation with the airline’s staff and refusal to comply with safety instructions during the flight. The charges against her were later withdrawn, and she was discharged of all charges. However, the incident attracted mixed reactions from Nigerians, with some questioning the fairness of the treatment.
In a separate incident, Nigerian Fuji musician, King Wasiu Ayinde (KWAM1), was not criminally charged for his behavior on a Nigerian airline. The NCAA's decision not to charge KWAM1 was linked to the nature and aftermath of the incident, including public and regulatory responses.
Michael Achimugu, the NCAA spokesperson, clarified in an interview with Daily Post that there is nothing unusual about the Ibom Air passenger being arrested and charged to court by the airline. He also stated that the NCAA's action in the Comfort Emmanson case was aimed at doing the right thing, and that the NCAA did not sue Comfort Emmanson; the airline exercised its right to sue her in court.
The NCAA did not sue KWAM1 in the given case, as the airline did not take him to court. The NCAA's decision to take action against Comfort Emmanson was due to the severity of her alleged misconduct and the airline’s formal complaint, while KWAM1 was not charged, possibly because his incident was handled less severely and involved a public apology.
The NCAA lacks prosecutorial powers in both cases, and the airline immediately arrested Comfort Emmanson and sued her in court after the incident. The NCAA criminally referred the case of KWAM1 to the Attorney General and Inspector General of Police since the airline did not sue or take him to court.
Peter Obi, the Labour Party 2023 presidential candidate, described Emmanson’s treatment as a double standard. The NCAA has no role to play in the case of Comfort Emmanson since it is in court. The NCAA's actions in both cases were aimed at doing the right thing, but the differing outcomes have sparked debate about fairness and consistency in the application of airline regulations.
