Margaret Caldwell, the mother of Emma Caldwell, has expressed her disappointment and fatigue at having to wait for the inquiry into her daughter's case to start. The Scottish government has ordered a judge-led public inquiry into the original police investigation of Emma Caldwell's murder, following accusations of failings that allowed the perpetrator, Iain Packer, to escape justice for a quarter of a century.

Justice Secretary Angela Constance has expressed her thoughts remaining with Margaret Caldwell and Emma's family. However, the family feels patronized by those within the justice department and treated like a box-ticking exercise. They feel betrayed by the Scottish government as the terms of reference for the inquiry were drafted without their input.

Aamer Anwar, the family's solicitor, has called for the inquiry to begin as soon as possible and urged for it to look at the Crown Office amid accusations of "misconduct" by some of the officers and lawyers involved in the case. The family was invited to input into the Terms of Reference (ToR) by the justice minister, but none of the potential draft ToR have been provided to them. The family was told that the suggested potential draft ToR are the property of the Crown Office and cannot be provided to them.

The Crown Office supports the public inquiry established by Scottish ministers and has a duty to act on the lord advocate's instruction of an independent investigation into potential criminality by police officers in this case. Both the independent investigation and the public inquiry can proceed in parallel, according to the Crown Office and Procurator Fiscal Service.

Several former sex workers have testified to our website about Packer's dangerous sexual behavior years before Emma Caldwell's murder. Packer was convicted last year and received a life sentence with at least 36 years in prison. Margaret Caldwell stated that she wants justice for Emma and has always asked for it from day one.

Justice Secretary Angela Constance has updated the family that the terms of reference for the public inquiry are being finalized. The search results do not provide information on who sets the final terms of reference for the public inquiry into the original investigation of the Emma Caldwell case.

In a recent meeting with the Scottish government, Aamer Anwar read a statement expressing the family's feelings of betrayal following the lack of transparency and inclusion in the drafting of the terms of reference for the public inquiry. The family hopes that the inquiry will bring clarity and accountability to the failures that allowed Packer to evade justice for so long.
