Promotion and Regulation of Online Gaming Bill, 2025: Paving the Way for E-Sports in India

The Indian government has drafted a new bill, the Promotion and Regulation of Online Gaming Bill, 2025, which aims to create a framework for e-sports and online games. This bill officially recognizes e-sports as a legitimate sport and sets forth regulations to promote its growth while distinguishing it from online gambling activities.

Definition of E-sports

Under the new bill, e-sports are defined as competitive games of skill played in virtual environments with rules and recognition. They are distinguished from online money games, which involve stakes or wagering of money or money's worth. E-sports must be recognized under the National Sports Governance Act, 2025, form part of multi-sport events, and have outcomes determined solely by skill factors such as physical dexterity, mental agility, or strategic thinking. They must be conducted in a multiplayer format governed by predefined rules and must not involve betting, stakes, or expectations of monetary winnings from such stakes.

Regulation of E-sports

To regulate e-sports, the bill proposes establishing a National e-Sports Authority. This authority will be responsible for overseeing the growth of competitive gaming, formulating rules for fair play, setting standards, and coordinating with state governments for policy integration. The bill encourages investment, training academies, awareness campaigns, and research centers related to e-sports, emphasizing its potential for employment generation and global competitiveness.

The National e-Sports Authority will have the power to inspect, investigate, and enforce rules to ensure strict compliance. It will also register online social games and work with law enforcement to stop illegal gambling.

Distinct from Online Money Games

The bill strictly prohibits online money games, defined as games involving stakes or wagers for monetary or other enrichment, whether based on skill or chance. E-sports, by contrast, exclude any form of betting or stakes-based winning, thus drawing a clear line between competitive gaming and gambling activities.

Promoting E-sports and Job Creation

The bill aims to create new opportunities for investment, job creation, and innovation in the e-sports and online games industry. It highlights how e-sports can boost the economy by bringing in both foreign and domestic investment, generating jobs, and helping India become a global center for competitive gaming.

Strict Penalties for Betting in E-sports

The bill proposes strict penalties for betting in e-sports, including fines and jail time for those involved in promoting or participating in such activities.

E-sports in India

India has already made its mark in the e-sports arena, with events such as the Indian Gaming League, an annual competition that attracts thousands of participants, and the ESL India Premiership, one of the major tournaments in e-sports in India, featuring several popular games. In 2022, India won the bronze medal in Dota 2 at the Commonwealth Esports Championship, further cementing its position in the global e-sports community.

The bill is likely to be tabled in the Parliament today, marking a significant step forward for the recognition and regulation of e-sports in India.
