Electoral lists proposed by the Chega party are officially turned down by the Constitutional Court in Rio Maior.
In the upcoming local elections in Rio Maior, several candidates from the party 'Chega' have been denied a spot in the Municipal Chamber, Parish Assembly, and Municipal Assembly due to the late submission of documents. The party had its appeal to the Constitutional Court (TC) dismissed, making the rejection of their candidacies final.
The TC ruled that the party's appeal was unfounded, citing a series of irregularities that were not rectified on time. These irregularities included the failure to submit required documents such as a formal declaration specifying nationality, a certificate of habitual residence in national territory, the last residence certificate in the state of origin, a certificate of non-impairment of passive electoral capacity in the state of origin, authorization of residence for at least two years, acceptance of candidacy, and honor commitment declarations.
In the list for the Municipal Assembly, none of the candidates' voter certificates were submitted. The rejection of the Municipal Chamber list was justified due to the third candidate, Dayane Túlio, not being a native of Rio Maior and having an invalid citizen card number. Moreover, in the list for the Rio Maior Parish Assembly, the actual candidate number 1, a Brazilian national with an indicated expired citizen card, did not submit documentation related to foreign citizenship.
The party head, Alexandre Costa, stated that the documents were only late by a few hours. However, the deadline for Chega to submit documentation had passed, and the documentation was only submitted on Tuesday, one day after the deadline. The court extended the deadline to Monday, but the party failed to meet it.
The party appealed to the TC, alleging 'justified impediment' due to one of the parish councils where the documents had to be requested being closed during the afternoon of August 22. However, the TC considered that not all irregularities required acts dependent on the Parish Council, so the reasons invoked would not justify the delay in submitting personal documents, residence documentation, acceptance declarations, and honor commitments.
The autonomy in Rio Maior is currently led by the Coalition Together for the Future (PSD/CDS-PP), which, in the last local elections, elected the president and four councilors. The candidates running for the Rio Maior Chamber in the upcoming elections are Ana Esperança (CDU), Miguel Paulo (PS), Luís Filipe Santana Dias (PSD/CDS-PP), and Luís Caetano (Livre).
With the rejection of Chega's candidacies, it remains to be seen how the upcoming local elections in Rio Maior will unfold. The party has been given a three-day deadline to submit the documentation, but the deadline has now passed, and the documentation was only submitted one day after the deadline. The TC's ruling marks a significant setback for Chega in the Rio Maior elections.
