The Federal Constitutional Court slapped down two organ complaints lodged by the BSW, declaring them inadmissible. The party barely made it past the 5% hurdle in the recent election, slipping up by a mere 0.02%. Apparently, they felt swindled and laid the blame on the Bundestag for not providing a legal mechanism for an immediate re-count when genuine concerns about the election result arose.

Determined to change the rules of the game, the BSW argued that the order of parties on the ballot papers should be revamped in the Federal Election Act. However, the Constitutional Court responded: "The applicant hasn't offered sufficient evidence proving the potential infringement of their equal opportunities rights."

In response to the BSW's demand for an immediate mechanism to recount votes in the event of a narrow fail, the Federal Constitutional Court stated they had merely "claimed" the Bundestag's negligence, without any constitutional grounds to back up such an obligation. As for the party's concerns regarding the regulations on the order of parties on the federal election ballot papers, the Court deemed their arguments misguided and skewed. The BSW ultimately yearned for an order that would give them a leg up over their rivals, and the Court found this argument confusing and baseless.
