Duterte Remains Imprisoned, No Interim Freedom Granted

Rodrigo Duterte, the former president of the Philippines, has not been granted an interim release by the International Criminal Court (ICC), contrary to a misleading video that has circulated on a YouTube channel.

On June 12, Duterte's legal team filed for interim release, citing humanitarian grounds and a host country willing to accommodate him under court conditions. However, the ICC Office of the Prosecutor strongly opposed the request, citing Duterte as a serious flight risk. The office also noted Duterte's previous threats to court personnel and the possibility of his political influence being used to intimidate witnesses or obstruct investigations.

The ICC Pre-Trial Chamber I deferred the decision on Duterte's interim release appeal on July 23, and as of writing, Duterte remains detained at Scheveningen Prison, The Hague. The court has yet to rule on Duterte's interim release request.

The video claiming that Duterte has been granted an interim release by the ICC has garnered 5,800 views, 414 likes, and 33 comments on the YouTube channel, which claims to be a news outlet and has 116,000 subscribers. On August 18, Duterte reiterated his request for temporary release. The conditions proposed by Duterte's defense team for his temporary release are yet to be confirmed by the ICC. The confirmation of charges hearing is scheduled for September 23.

Duterte was arrested on March 11, 2025, on charges of crimes against humanity related to his administration's bloody drug war. The ICC's decision on Duterte's interim release request will have significant implications for the course of the trial.
