Defiant Dobrindt Pushes Border Controls Despite Legal Conundrum

In the face of a recent court ruling casting doubt on the legality of border rejections, Federal Interior Minister Alexander Dobrindt (CSU) maintains his stance. "We stand by our legal argument," he declared in Berlin.
Dobrindt repeatedly emphasized that his approach hinges on individual cases. "There's no reason to alter our practice due to today's court decision in this very specific case."
Berlin Administrative Court: Border Rejections Illegal under Current Rules
The Berlin Administrative Court, in a swift decision, deemed the rejection of asylum seekers at border controls on German soil to be illegal. The so-called Dublin procedure, which determines the EU country responsible for an asylum process, was absent in this specific case, the court ruled.
This decision concerned three Somali individuals who were turned away from Poland to Frankfurt (Oder) on May 9 under new rules.
Navigating Turbulent Migration Waters
Dobrindt imposed tougher border controls and the ability to deny entry to asylum seekers shortly after assuming the Federal Interior Minister role on May 7. However, these measures would not apply to pregnant women, children, and other vulnerable groups.
Between May 8 and June 1, a total of 2,850 people were denied entry, according to Dobrindt's figures. In 179 cases, an asylum application was submitted. Out of these, 138 resulted in rejections, while 41 involved vulnerable individuals.
The three Somalis who filed the lawsuit in Berlin attempted to enter Germany on May 2 and 3 without filing asylum applications. They only applied on their third attempt on May 9.
"This example highlights the complexity of the situation and the apparent dysfunctionality of the entire asylum system," Dobrindt lamented.
