Dispute on Ground Floor Resolution: Minister Offers Family Assistance - Disputed Land: Ministry Offers Family Solidarity

Taking a sympathetic stance, Brandenburg's Minister of Justice, Benjamin Grimm (SPD), has promised ongoing monetary assistance from the state in the protracted legal tug-of-war over a family's house and property in Rangsdorf, south of Berlin. Grimm admitted to the "Berliner Zeitung" that a peaceful resolution may not be achievable, given the heartache endured by the family.

Grimm declared, "Given the undeniably heavy financial strain the extended legal battles impose on the family, it's crucial to alleviate this burden by covering legal expenses and relentlessly persevere on this front."

Grimm: "Administrative oversight."

The family purchased the property at auction in 2010 and constructed a house upon it. However, the original owner resurfaced claiming the property in 2014, following a misstep by the state in locating them initially.

In 2023, the Higher Regional Court (OLG) mandated the family to demolish their dwelling and vacate the premises. The Federal Court of Justice concurred with the plaintiff's ownership rights but ruled that the family deserves reimbursement for the construction expenses of their house. The case is currently back at the OLG.

The "Berliner Zeitung" interviewed Minister Grimm, who stated, "It was an administrative oversight, there's no denying that. The state acknowledges its role in this mess." Apart from financial support for legal fees, after another court decision, "further potential losses incurred will be examined, and compensation may be warranted if applicable."

The state won't evade responsibility, Grimm emphasized, "We won't nitpick, but we must adhere to legal guidelines."

Regrettably, the original owner remains uncooperative, Grimm explained. The proposal for an out-of-court settlement has yet to be accepted.
