New Prison Construction Dispute Hits the Courts

The construction of a new penitentiary in Zwickau, intended to house prisoners from Saxony and Thuringia, has become the subject of a legal tussle in the courts. The crux of the dispute? Access to all construction documents stored on a server. The legal spat ensued after the termination of the contract with the general planner, leading to a disagreement over server access. Surprisingly, the server wasn't operated by the general planner but by a third-party company with whom the state of Saxony, the project client, hadn't entered into a contract. Subsequently, access was denied. In response, the state decided to take the matter to court.

In an interim judgment, a civil chamber recently ordered the planner not to deny the state access to the project server. However, the planner was mandated to provide the data to the state via a new server, without terminating its existing contract with the server operator until a definitive court ruling was passed. The court validated the state's claim to all documents produced post-contract termination with the general planner.

The proposed XXXL prison, with a capacity to house up to 820 inmates, intended to replace older prisons, has seen numerous delays since its initial planned opening in 2019. The project's escalating costs have also been a point of concern. In October, Saxony announced the termination of its contract with the general planner, citing inadequate service provision as the reason. The firm refuted the allegations, marketing itself as a casualty of the state's efforts to cover up its own misconduct.

Uncertainty now surrounds not only the project's completion date but also its final costs, rumored to have surpassed the 300-million-euro mark. Both parties can appeal against Friday's decision at the Dresden Higher Regional Court.
