Judge Lewis J Liman of the Southern District of New York snubbed Blake's wish to withdraw her claims on Tuesday, remarking that the dismissal would only be possible if both parties nodded to the terms.
In a brief order, Judge Liman asserted, "The motion to compel ... is denied based on Plaintiff's representation that the relevant claims will be withdrawn."
As per Deadline, Liman further specified that Blake's request to waive her emotional distress claims was turned down “without prejudice to renewal,” allowing Blake's legal team room to file another dismissal request if needed.
The judge's verdict highlighted the worsening situation by stating that, should Blake persist with her emotional distress claims, she’d be barred from presenting any evidence related to such distress in the case.
"For avoidance of doubt, if the claims are not dismissed, the Court will preclude Blake from offering any evidence of emotional distress," Judge Liman declared, as reported by Deadline.
Blake's legal team, led by lawyers Esra Hudson and Mike Gottlieb, responded to the verdict with a statement expressing their regret over the decision. They underlined that Blake was still pursuing emotional distress damages through other claims, including allegations of sexual harassment and retaliation.
"The court denied Wayfarer's motion," said Lively's lawyers, adding, "He instructed the parties to continue their discussions on technicalities regarding the dismissal of two out of 15 claims. Blake has promised to relinquish those claims because they’re no longer required, and she will still chase emotional distress damages via other claims in her lawsuit."
The legal dogs unleashed an accusation of retaliatory tactics against Justin and Wayfarer Studios, asserting that these actions could lead to severe legal and financial repercussions due to California laws.
"This is precisely where both parties were before the Baldoni-Wayfarer troop rashly filed this senseless motion to compel, all in the hunt of yet another media moment," they added, as quoted by Deadline.
