Diddy's former litigant seeks to overturn the verdict on the allegation of inappropriate claim misuse

In a recent ruling, U.S. District Judge Jed S. Rakoff has dismissed 21 out of 22 claims in Sara Rivers' lawsuit against Sean "Diddy" Combs, stating that they were time-barred or legally insufficient. The remaining claim is still pending.

Rivers, a former contestant on MTV's "Making the Band 2" and a member of the hip-hop group Da Band, assembled by Combs, has accused the music mogul of verbal harassment, controlling her schedule, and forcing her to perform menial tasks, including a walk to Brooklyn to deliver cheesecake, which was recorded for the show. She has also alleged that Combs sexually harassed her in 2002 during the filming of an MTV series, including groping her breasts and retaliating against her in the music industry after she rejected him.

Combs' attorney, Erica Wolff, has stated that the ruling confirms the allegations in Rivers' lawsuit are "unfounded, time-barred, and legally unsustainable". Combs continues to face multiple civil lawsuits for alleged sexual misconduct.

The court case is being held in the U.S. Court of Appeals for the Second Circuit, with the name of the court where Rivers filed her appeal being the New York Supreme Court, Appellate Division. The court will decide on the remaining claim once it has clarified whether New York City's "Gender Motivated Violence Protection Act" allows an extension of the statute of limitations for lawsuits.

Combs remains in custody pending his trial for two counts of promoting prostitution.
