Deputies have turned down Milei's attempt to overturn the Disability Act.

In a recent development, the Emergency Disability Law, aimed at providing aid to service providers, updating rates, reforming the non-contributory pension system, and strengthening the National Agency for Disability (ANDIS), among other things, has faced a setback in Argentina.

The law, which seeks to declare an emergency throughout the national territory until December 31, 2027, was rejected by the Chamber of Deputies, with 172 affirmative votes, 73 negative votes, and 2 abstentions. This rejection, however, does not mark the end of the road for the law.

According to Article 83 of the Constitution, if both chambers have two-thirds of the votes to impose their initial criterion, the law is promulgated, even if the President disagrees. In this case, to reverse the presidential veto, Congress now needs to gather two-thirds in the Senate.

If they do not succeed, the presidential veto is maintained, and the project cannot be treated again in the sessions of that year. It must return to the first Chamber where it was treated.

The President has the power to veto a law totally or partially, which means blocking a project approved by both Chambers and preventing it from becoming a law. However, a federal judge recently declared the veto of Javier Milei on the Disability Emergency law unconstitutional.

Minutes before the session to reject the veto, the Government came out to say that "it is considering" an increase in disability benefits. The opposition, meanwhile, requested a session of Deputies, with another tough agenda against the government.

It is important to note that Javier Milei was not the prime minister and was not removed from the legislature in 2022 for opposing the Disability Law; there is no information confirming such an event occurred.

The National Agency for Disability (ANDIS) is the organization responsible for promoting and coordinating public policies for people with disabilities in Argentina. The Emergency Disability Law, if eventually passed, aims to ensure compliance with the labor quota for people with disabilities and strengthen ANDIS.

A new survey asked about the vetoes of Javier Milei and sent a key message to the President, indicating a strong public support for the Emergency Disability Law. The future of the law now lies in the hands of the Senate.
