Federal authorities will overturn the OVG ruling, sending the case back for reconsideration. The Moroccan man was deported on July 11, prompting criticism from politicians who argued that an urgent suspension of the deportation order by the Chemnitz Administrative Court had not been communicated to federal police.
Earlier this summer, just days after the deportation, the OVG concluded that the man did not need to be returned. Inga Stremlau, the lawyer for the affected person, advocated for a prompt resolution, "Given the significant violations of fundamental rights, timely redress would be appropriate, ideally in the form of accelerated return of the affected person. If this is not immediately possible, we at least recommend a straightforward and swift visa procedure."
