Defence strategies in Varma's case rely on the presentation of concealed funds as evidence.

India's judicial institutions are swirling in controversy, as justice Yashwant Varma's name surfaces in an unusual scandal involving cash found at his residence. Here's a lowdown on the burning issue:

Who is Justice Yashwant Varma?

Born on January 6, 1969, in Allahabad, justice Yashwant Varma graduated from Hansraj College, Delhi University, and Rewa University with a B.Com and LLB, respectively. He began his career as an advocate in 1992, tackling constitutional, labor, industrial, corporate, and taxation cases at the Allahabad High Court. After climbing the ranks, he served as the Special Counsel for the Allahabad High Court and the Chief Standing Counsel for the State of Uttar Pradesh before his designation as a Senior Advocate in 2013[1].

He was appointed as an Additional Judge at the Allahabad High Court in 2014 and became a Permanent Judge in 2016. In 2021, he moved to the Delhi High Court, but was transferred back to the Allahabad High Court in 2025, following a controversial incident[1].

Accusations Loom

The controversy started with a fire at Varma's residence in Lutyens Delhi on March 14, 2025. Allegations regarding a vast cache of cash emerged, despite Varma's denial. An in-house inquiry committee was formed to examine the matter, and, despite Varma's assertion that no cash was placed in the storeroom by him or his family members, the committee found credence in the allegations[2][3].

Following the incident, Varma was moved from the Delhi High Court to the Allahabad High Court and was relieved of any judicial responsibilities. A Supreme Court-appointed panel completed a report on the allegations, which has been shared with Varma, providing him the chance to resign. If he declines, the impeachment process may be initiated[1].

Sifting Through the Ashes

Amidst the accusations, questions have been raised about the clean-up that took place after the fire, the absence of CCTV footage, the lack of forensic analysis, and allegations of tampered evidence. These allegations persist despite the panel's conclusion that the cash was found in Varma's official bungalow, and he must be held accountable[2].

Varma's defence questions the identity of the police officer who reported the discovery of cash, citing the unclear origin of the WhatsApp message that was forwarded to Delhi high court Chief Justice Upadhyay. He also brings attention to the absence of CCTV footage, the lack of any conclusive forensic analysis, and the possibility of the money being hidden or planted[2].

Shadows of Distrust

Varma's defence further suggests that his outhouse could have been used to hide the money or that it may have been "staged" as part of a scheme against him. This argument rests on the observation that the outhouse wasn't locked, and many people had access to it[2].

Although the panel concluded that Varma showed "unnatural conduct" indicative of his guilt, Varma's defence maintains that he wanted to address the charges in a personal meeting with Chief Justice Sanjiv Khanna. The panel's findings state that Varma "meekly" accepted his transfer to the Allahabad High Court, but Varma argues that the transfer was a means to counter other accusations and that he ultimately received an ultimatum to step down or face impeachment[1].

A Rapid Judgment?

The Chief Justice of India aims to decide on Varma’s case before his retirement, a decision that many view as one of his final major undertakings[1]. The future for justice Yashwant Varma remains uncertain, and the judge now stands at the crossroads of his career, teetering on the edge of blotting his name in the annals of India's constitutional court history. Only time—and perhaps more evidence—will ultimately decide his fate.
