Germany's political landscape is brewing with controversy surrounding the potential ban of the Alternative for Germany (AfD) party. Lower Saxony's Minister President Olaf Lies (SPD) has signaled his support for initiating a ban procedure, provided the party has demonstrated signs of unconstitutional activities that undermine the democratic order.

"This is a steep hurdle, but if it becomes feasible, politics must act," said Lies to the German Press Agency. "We owe it to uphold the rule of law and take responsibility for ensuring that parties advocating for the destruction of essential elements of our democratic system are either banned or disqualified from receiving state financing."

So, what constitutes these unconstitutional activities? Lies explains that the party must demonstrate a relentless pursuit towards abolishing the backbone of the liberal democratic order, and there must be a high likelihood that these unconstitutional activities could succeed.

Alexander Dobrindt (CSU), Federal Interior Minister, has issued a warning against launching a ban procedure. "Those who believe they can legally outmaneuver the AfD and its ideological influence will be in for a rude awakening," said Dobrindt to Funke media group newspapers earlier in June. "We should refrain from making it appear as if we aim to eliminate a political adversary through legal means." Instead, Dobrindt prefers to tackle the AfD with political maneuverings.

In the face of party ban talks, Lies underscores the need for stronger, more credible politics. "The AfD's high approval ratings can be attributed, in part, to our failure to retain certain voters as democratic parties. Therefore, we need to usher in a new era of meaningful, collaborative politics to restore unity within our society," Lies explained. "It's about mending fences and reconciling our fractured society. We are currently witnessing discord."

According to Lies, the strengthened grip of the AfD on voter support may be linked to widespread uncertainty surrounding future prospects, particularly among working-class individuals. "Regardless, we must press on with the changes and usher in more digitization and an updated socioeconomic landscape," said Lies. "However, we need empirical evidence that our proposed solutions are effective. For example, through green steel and electric vehicle markets, we must demonstrate that the necessary transition to a greener economy redounds to the benefit of citizens."

The AfD in Lower Saxony has been under investigation as a suspected right-wing extremist group since May 2022 by the Office for the Protection of the Constitution (BfV), Germany's domestic intelligence service. On Thursday, Interior Minister Daniela Behrens (SPD) and President of the Office for the Protection of the Constitution Dirk Pejril will present the constitution protection report for 2024 in Hanover.
