Favoring a Fair AfD Ban: A Political Duty to Uphold Justice
Unfounded claims of banning AfD disregard the need for upholding legal principles in politics - Deceitful Claims Regarding AfD Ban: Safeguarding Legal Integrity in Politics
In a straightforward conversation with the German Press Agency, Lower Saxony's Minister President Olaf Lies (SPD) expressed his support for an AfD ban procedure, if the right legal grounds are met. He urged caution in determining the need for a banned, as it's a high bar to clear.
"Politics has a high hurdle to jump," Lies said, "But if it can be feasibly achieved, politics is compelled to act." The responsibility for upholding the rule of law demands prompt action against a party that may threaten constitutional values.
Conditions for such a ban include a party's intention to end basic elements of the liberal democratic order and their persistent pursuit of this goal. The possibility of this unconstitutional activity succeeding must also be realistic.
CSU's Alexander Dobrindt, Federal Interior Minister, previously warned against hasty ban procedures. "Those believing they can legally vanquish the AfD and dismantle its ideological sway will wake up to a bitter reality," Dobrindt stated. Instead, he advocated for a political defeat of the AfD rather than a legal one.
Lies also stressed the importance of strengthening politics, enabling citizens to trust other parties over the AfD. "The AfD's popularity soars partially due to lost trust in traditional democratic parties," Lies admitted. Hence, innovation is needed—a new constructive politics that fosters unity in a divided society.
Lies attributes the AfD's rise, particularly among traditional SPD voters, to concerns about the future. However, he maintains, necessary changes should not be halted. Instead, the focus should be on demonstrating that progressive solutions yield tangible benefits for citizens.
The Lower Saxony AfD chapter has been under watch by the Office for the Protection of the Constitution since May 2022. On Thursday, officials will present their latest report on constitutional protection in Hannover. The AfD is currently challenging its classification as a "confirmed right-wing extremist endeavor" in court[1].
