Detaining Cardiologist Underfire: Defense Shuts Down Allegations of Two Patient Deaths
The cardiologist under scrutiny for the alleged deaths of two patients in Berlin's prestigious Charité hospital is adamantly denying the accusations levied against him. During the trial, which has spanned eight days in Berlin's Regional Court, the 56-year-old specialist in internal medicine explained that the patients were experiencing an "acute dying process," causing him to administer a sedative to alleviate their suffering.
The defendant's lawyer insisted that he had no intention of hastening their demise, emphasizing, "He is certain that he did not shorten the lives of the patients." The indictment, however, maintains that the caretaker unlawfully administered overdoses of medication to both patients in 2021 and 2022, resulting in their fatalities. A 39-year-old nurse is also being charged with aiding and abetting the first patient's manslaughter.
A young nurse initiated the court proceedings anonymously as part of a confidential whistleblower system, alerting trusted lawyers to any observed discrepancies within the medical facility.
The senior physician vehemently disputes the "alleged observations and feelings" of the anonymous nurse. His counsel argued that his only fault lay in failing to document the administration of Propofol in the patients' records. He had administered the sedative to prevent pain and stress since further lifesaving treatment was no longer an option for either individual.
The alleged poisoner has been in custody since May 2023. Previously, he had been released by Charité in August 2022. The prosecutor's office initially suspected double murder, as claimed in their indictment. However, the regional court reconsidered this assessment during the trial's opening, concluding that there was mere justification for manslaughter accusations in each case, as motives and premeditation remained unclear.
