Former MP Daryl Maguire Jailed for Misleading Evidence

Daryl Maguire, a former Australian MP, has been sentenced to 10 months in jail, with a non-parole period of five months, for giving misleading evidence to the Independent Commission Against Corruption (ICAC) during a 2018 inquiry into a Sydney council.

Maguire, who represented Wagga Wagga as a Liberal and later as an independent until 2018, was found to have given deliberately misleading testimony concerning potential profits from a major property development deal involving former Canterbury City councillor Michael Hawatt. The court determined that Maguire stood to receive about $720,000 in commission if the property was sold, contrary to his claims that there was nothing in it for him.

The inquiry related to a Sydney council in 2018. During the investigation, Maguire denied any business dealings or financial gain related to the property deal. However, the court found this evidence to be misleading. Magistrate Clare Farnan noted Maguire's lack of remorse and the difficulty in determining his motivation since he maintained innocence and offered no explanation for his false evidence.

The sentence also took into account an almost five-year delay in prosecution, which reduced what could have been a 12-month term. Despite being jailed, Maguire was granted bail about an hour after sentencing while an appeal against the conviction and sentence was launched.

Maguire, known for his secret relationship with Gladys Berejiklian while she was NSW premier, made headlines in 2020 for being in a secret 'close personal relationship' for at least five years with Berejiklian while she was treasurer and then premier. Former deputy prime minister Michael McCormack provided a letter of support for Maguire to the court.

Maguire's lawyer has indicated an appeal will be filed. Maguire served in the NSW coalition governments until his retirement in 2018. In her ruling, Magistrate Farnan stated that Maguire's evidence was misleading, and he has not demonstrated any remorse, according to the magistrate.
