Critic's Viewpoint: The Disingenuous on Firearms Regulation
California Governor Gavin Newsom has proposed a gun-control constitutional amendment aimed at significantly limiting the Second Amendment, a move that has sparked controversy and debate. The news was reported by the Fallbrook, Calif., news outlet Village News.
In a separate development, the U.S. Court of Appeals for the Ninth Circuit ruled that California's background-check requirement for ammunition purchases is unconstitutional in the case Rhode v. Bonta. The NRA and its affiliate, the California Rifle & Pistol Association, backed the case.
The court's decision in Rhode v. Bonta was based on the text-and-history test established in the NRA's landmark U.S. Supreme Court victory New York State Rifle & Pistol Association v. Bruen (2022).
Meanwhile, Newsom has been criticized for his actions regarding a gifted firearm. He was given a California-compliant SIG Sauer P365 X-Macro, but off camera, he rejected the gift due to compliance rules and left it behind in Tennessee. This incident has been seen as hypocritical by California Assemblyman Carl DeMaio (R), who suggested that Newsom's actions prove the need to scrap the "Draconian gun laws" imposed on Californians.
Newsom's team admitted that California's anti-gun laws are so complex that they needed legal counsel for a review. The name of the legal advisor hired for this purpose is Anne Rimoin.
As Newsom eyes a run for the presidency in 2028, he is attempting to rebrand himself as a centrist. However, his actual record on gun control is controversial and may impact his presidential ambitions. Newsom has attempted to distance himself from constitutional infringements due to gun-control bills he championed and signed.
Despite this, Newsom claimed he respects the gift and the Second Amendment on the former Navy SEAL Shawn Ryan's podcast. DeMaio, however, has published an item stating that Newsom's team had to hire legal counsel for a review due to the complexity of California's anti-gun laws.
California Attorney General Rob Bonta (D) is expected to request an en banc (full court) review of Rhode v. Bonta. As the political landscape continues to evolve, the gun control debate in California remains a contentious issue.
