Significant computer problems hinder trial processes in Bavaria - Court setbacks due to extensive IT complications in Bavaria's judicial system
The Bavarian justice system is taking significant steps to enhance its digital resilience, following a series of disruptions in recent weeks and months. In a bid to prevent future IT issues and ensure smooth court proceedings, various strategies have been proposed.
Firstly, enhanced cybersecurity measures will be implemented. This includes the use of advanced tools such as VPN services and software-defined WAN (SD-WAN) solutions to secure internet traffic and ensure data privacy. Open-source password management tools, aligning with EU security standards, will also be adopted for safer credential sharing and storage.
Secondly, data protection and compliance will be prioritised. Binding Corporate Rules (BCR) similar to those used by Munich Re will be implemented to securely transfer personal data within and outside the European Economic Area (EEA), maintaining GDPR standards. Regular audits will also be conducted to ensure all digital systems comply with relevant data protection regulations.
Thirdly, a digital forensics strategy will be developed, drawing lessons from the Digital Forensics Summit on integrating digital forensics into police reform. Clear incident response plans will also be established to quickly address and mitigate IT disruptions.
Fourthly, collaboration and training will be emphasised. Inter-organizational collaboration will be fostered to share best practices and stay updated on the latest cybersecurity threats and solutions. Continuous training for staff will also be provided to ensure they are equipped to handle emerging challenges and maintain system resilience.
Lastly, innovation and modern IT infrastructure will be invested in. The IT infrastructure will be regularly updated to ensure it is reliable, secure, and adaptable to new technologies. Innovative digital solutions that enhance efficiency and security in the justice system will also be encouraged.
The spokesperson for Justice Minister Georg Eisenreich has confirmed that all disruptions to the electronic file have been resolved. However, they acknowledge that IT disruptions cannot be completely avoided or predicted, given the system's complexity and some technical components being in the responsibility of external service providers.
The concerns about the digital resilience of the justice system are not limited to one party. The Bavarian Richterverein, an association of judges, has previously complained about the unstable IT systems, stating that disruptions lead to a "disastrous external effect" and considerable legal uncertainty. Court proceedings have been postponed due to disruptions in March and July 2025.
In response to these concerns, comprehensive measures have been taken to prevent future disruptions. An early warning system has been set up for the Bavarian justice system, and an interdisciplinary working group has been established by the Ministry of Justice to examine improvement options for the electronic file with external service providers.
The Greens in the Bavarian state parliament have also expressed concern about the digital resilience of the justice system, questioning its preparedness to handle technical problems or cyberattacks. Toni Schuberl, spokesperson for law of the Greens, stated that IT problems affecting the justice system to such an extent that it has to temporarily suspend operations is a significant issue.
Schuberl emphasised the need for the employees of the justice system to work efficiently, as there is more than enough work at public prosecutor's offices and courts. The digital infrastructure of the justice system is questioned in terms of its resilience and operational capabilities, including in the event of technical problems or cyberattacks.

Community policy will be revised to incorporate provisions for improved digital resilience, focusing on the prevention and management of IT disruptions and cyberattacks. Vocational training programs in the field of cybersecurity will be instated, offering continuous education for judges, public prosecutors, and court staff to enhance their digital skills and adapt to emerging threats. Additionally, the general news media and political bodies, including the Greens in the Bavarian state parliament, will be kept informed on the progress and implementation of these measures amidst growing concerns about the digital resilience of the justice system.
