The vote, held during the city's regular meeting on May 16, 2024, was 3-2 in favor of banning the LGBTQ+ Pride flag. Mayor Pro Tem Hector Sosa brought the item forward for a vote.

The controversy stems from a social media post by Councilman Trujillo on September 10, 2025. The post, an Instagram Story, read, "No one mourns the wicked," which many interpreted as a reference to conservative activist Charlie Kirk, who was fatally shot at Utah Valley University on the same day. Councilman Trujillo issued a statement through his official council account the following day, clarifying his stance. The statement read, "I do not condone any form of violence, whether political or otherwise."

The special meeting on September 17, 2025, at 4 p.m., has been scheduled by the Downey City Council itself. The purpose of the meeting is to decide whether Councilman Mario Trujillo should be formally censured. A censure does not carry legal penalties, but it is considered one of the strongest rebukes a council can deliver to a sitting member.

The Pride Flag Raising Ceremony is expected to be a symbolic act of solidarity and support for the LGBTQ+ community in Downey, despite the city's ban on the Pride flag. The ceremony will take place at the LA County Office of Education in Downey, and community members may submit comments in person or by email prior to the discussion.
