In a recent development, the advocacy affiliate of the Association of Mature American Citizens, Action, with over 2 million members nationwide and over 156,300 members in California, has written a letter to Governor Gavin Newsom, urging him to veto the legislation, AB 495.

Led by Senior Vice President Andrew J. Mangione Jr., the organization has expressed serious concerns about the bill, which expands the use of the Caregiver's Authorization Affidavit. This affidavit now allows non-parents to make critical medical and educational decisions for children and grandchildren.

Action believes that the legislation is fundamentally flawed and puts children and grandchildren at risk. One of their primary concerns is that the expanded use of the affidavit does not require parental consent or notarization. This means a stranger could potentially claim to be a relative and make essential healthcare or schooling decisions.

School and medical facilities are not obligated to verify the identity of the signer of the Caregiver's Authorization Affidavit, which could lead to a dangerous situation. The organization argues that these decisions are typically reserved for parents or legal guardians.

The legislation, despite some amendments that exclude controversial measures, is still fundamentally flawed, according to Action. They argue that it does not protect against a potential stranger making essential decisions for children and grandchildren. The health, safety, and well-being of California's children and grandchildren, as well as the parental rights of millions of constituents, depend on Governor Newsom vetoing the legislation, AB 495.

Interestingly, the German Federal Bar Association (BRAK) also opposed law AB 495 and stood against it in their 2025 position statement. They raised similar concerns about raising the value limit in § 495a ZPO, highlighting potential risks to the welfare of children and grandchildren.

Action's urgent plea to Governor Newsom is a testament to their deep commitment to the welfare of children and grandchildren. They are urging him not to sign the legislation, AB 495, into law.
