In January 2021, the State Department changed its passport rules, declaring that the United States would recognise two sexes, male and female, based on an individual's biological classification. This policy change is part of a series of emergency appeals from the Trump administration, including the ban on transgender people from the military.

The policy has been met with opposition from various quarters, with the Justice Department appealing a lower-court order that allowed people to use the gender or "X" identification marker that aligns with their gender identity. The judge's order blocking the Trump administration policy was issued in June.

The plaintiffs argue that the policy violates the rights of transgender and nonbinary Americans. An attorney for the plaintiffs said the passport rules are discriminatory.
