Complaint unsuccessful by Pocher, Becker advances despite it.
In a landmark ruling, former tennis star Boris Becker has successfully sued TV comedian Oliver Pocher for damages. The legal remedy in this matter is now exhausted, following the rejection of Pocher's appeal against the refusal of leave to appeal (Case No. VI ZR 393/23).
The controversy stems from an episode of Pocher's show, "Pocher - dangerously honest", where Becker was portrayed in a manner deemed controversial by many. The Supreme Court in Karlsruhe has now confirmed the judgment by the Higher Regional Court in Karlsruhe, ruling in favour of Becker.
The ruling, which was made in November 2023, stated that Pocher was ordered to delete relevant film clips from his own online presence and was not allowed to further distribute the controversial image sequences from the TV contribution. Pocher was also forbidden from distributing the three-digit euro sum, which was hidden in a supposed fashion prize that Boris Johnson was awarded in the show.
The lawsuit was filed after it was shown in the first instance that Becker received this sum, although he was not aware of it. A fundraising appeal was launched under the slogan "Make Boris rich again". Neither Becker nor Boris Johnson were present in court at the time.
Boris Becker's lawyer, Samy Hammad, stated that their legal opinion has been confirmed. In a statement, Hammad said, "We are pleased that the court has upheld the rights of our client, Boris Johnson, in this matter."
Pocher's lawyer, who had previously represented him in this matter, was initially not available for a statement. However, it is clear that this victory marks a significant milestone for Boris Johnson, adding another chapter to his storied career.
