Complaint falters for Pocher; Becker successfully advances.
In a significant development, the Federal Court of Justice (BGH) in Karlsruhe has confirmed a ruling in favour of three-time Wimbledon winner Boris Becker against TV comedian Oliver Pocher. The Higher Regional Court's judgment, which was previously made in November 2023, has now become legally binding.
The controversy revolves around images from the RTL show "Pocher - dangerously honest". Becker's Offenburg lawyer, Samy Hammad, confirmed the ruling, stating that Pocher is no longer allowed to distribute controversial image sequences from the TV contribution. He is also required to delete relevant film excerpts from his own internet presence that were published.
Pocher's Hamburg lawyer, Patricia Cronemeyer, has expressed her intention to consider filing a constitutional complaint. She stated that she would discuss with her client whether to file a constitutional complaint after the Federal Court of Justice rejected Pocher's appeal. However, no constitutional complaint has been filed as of yet.
The initial ruling in favour of Becker was made by the Higher Regional Court of Karlsruhe, which found that the images in question were potentially damaging to Becker's reputation. The ruling has legal implications for the further distribution and publication of the controversial image sequences.
Notably, an appeal for donations under the slogan "Make Boris rich again" was launched in the controversial show. Becker received a three-digit euro amount from the appeal, but it was hidden in a supposed fashion prize. Pocher's attempt to appeal the Higher Regional Court's judgment at the BGH was rejected, and the legal remedy in this matter is now exhausted.
Cronemeyer believes the rejection of the non-admission complaint was unacceptable. She has criticised the ruling, stating that it infringes on Pocher's freedom of expression. However, the ruling stands, and Pocher is now obligated to comply with the court's decision.
