Climate change case involving youth in Ontario set for re-examination in December
The case challenging Ontario's 2018 decision to replace its climate target with a weaker one is set to return to court on December 1 and 2, 2025, in the Ontario Superior Court. This hearing is a continuation of the historic constitutional challenge initiated by a group of young climate activists who argue that the weaker climate targets violate their Charter rights.
The case took a turn in favour of the activists when Ontario's highest court issued a ruling on appeal, overturning the previous decision that the climate target did not violate the constitution. As a result, the case was sent back to the lower court for another hearing.
The first hearing in 2022 saw an Ontario Superior Court judge agree that the target fell "severely short of the scientific consensus" but did not find it a violation of the constitution. However, this ruling was not the final word, as the case was sent back for another hearing due to the Ontario's highest court's ruling on appeal.
The second hearing will take place in the Ontario Superior Court, and the outcome is not yet available. The hearing is occurring because Canada's top court dismissed the province's request for it to weigh in on the case.
The activists argue that the weaker climate targets will allow dangerously high greenhouse gas levels, which will have severe consequences for their future. The case is of significant importance as it sets a precedent for other provinces and countries in their efforts to combat climate change.
The hearing is scheduled for December 1 and 2, and the location is the Ontario Superior Court. The second hearing is not the initial hearing, as it has been dismissed and re-opened due to the Ontario's highest court's ruling on appeal.
The people of Ontario and the wider world will be watching closely as the court makes its decision on this important case. Stay tuned for updates on the outcome of the second hearing.
