"Chief Justice of India, BR Gavai, expresses regard for all religions amidst the uproar over his remarks in the Vishnu idol case dispute"
The Supreme Court of India is currently hearing a petition regarding the restoration of a 7-foot beheaded ancient idol of Lord Vishnu at the Javari temple in Madhya Pradesh. The petitioner, Rakesh Dalal, alleges that the idol was mutilated during Mughal invasions and has remained in that state despite repeated representations to the government to restore it.
The petition recounts the history of the Khajuraho temples, originally built by the Chandravanshi kings, and highlights the colonial neglect and post-independence inaction that left the idol unrepaired even 77 years after independence. The Khajuraho temple in which the idol is located is part of the UNESCO-listed Khajuraho group of monuments.
The question of whether the Vishnu idol should be restored lies within the domain of the Archaeological Survey of India (ASI) and not the Court. However, the petitioner argues that the refusal to restore the idol violates devotees' fundamental right to worship. Senior Advocate Sanjay M Nuli appeared for the petitioner in the Supreme Court.
The comment that sparked backlash was made by the current Chief Justice of India (CJI), BR Gavai, on September 16. CJI BR Gavai made a comment about the plea to restore the 7-foot beheaded ancient idol of Lord Vishnu at the Javari temple in Madhya Pradesh. Solicitor General Tushar Mehta observed that reactions to events often get blown out of proportion on social media.
CJI BR Gavai assured that he meant no disrespect regarding the comment. He stated that every action has disproportionate social media reaction, referencing Newton's law. The comment made by CJI BR Gavai on September 16 sparked backlash, with some quarters terming it as hurtful to Hindu sentiments. However, CJI BR Gavai clarified that he meant no disrespect.
The petition also highlights protests, memoranda, and campaigns in relation to the temple that went unanswered. The petitioner, Rakesh Dalal, seeks the restoration of the mutilated idol to uphold the devotees' fundamental right to worship. The case is ongoing in the Supreme Court of India.
