Chairman of the National Assembly backs resolution enabling Prosecutor's Office to instigate civil litigation.
The National Assembly of Vietnam has adopted Resolution No. 205/2025/QH15, granting the People's Procuracy the authority to initiate civil lawsuits to protect the civil rights of vulnerable groups and public interests. This resolution marks a significant milestone in strengthening Vietnam's legal system and better safeguarding its citizens' rights.
## Scope and Purpose
The resolution will be piloted in major cities, including Hà Nội, HCM City, and Đà Nẵng, starting from January 1, 2026, for a period of three years. Its primary aim is to enhance the legal framework by giving the People's Procuracy a more proactive role in the protection of vulnerable groups and public interests.
## Implications
### Protection for Vulnerable Groups
By allowing the People's Procuracy to initiate civil lawsuits, the resolution offers stronger legal recourse for vulnerable groups, such as children, the elderly, and those in disadvantaged socio-economic conditions. This can lead to more effective enforcement of their rights and interests.
### Public Interest Protection
The resolution also aims to safeguard public interests by enabling the People's Procuracy to intervene in cases where public rights are compromised, potentially including environmental, health, or consumer rights issues.
### Strengthening the Judicial System
The initiative could enhance the efficiency and balance of Vietnam's judicial system by providing a more proactive role for the People's Procuracy alongside the judiciary and other legal bodies.
In complex cases involving significant damages, occurring across multiple districts, involving foreign factors, or when deemed necessary, the provincial procuracy may initiate lawsuits or conduct inspections, verifications, and evidence collection before assigning the district procuracy to initiate the lawsuit. Civil lawsuits initiated by the procuracy to protect public interests shall not be subject to mediation, and the defendant cannot file a counterclaim.
In cases where the resolution does not provide specific guidance, provisions of the Civil Procedure Code and other relevant laws shall apply. The procuracy is also authorized to request agencies, organizations, or individuals to cease violations and take measures to prevent or remedy consequences.
Nguyen Huy Tien serves as the Chief Prosecutor of the Supreme People's Procuracy, and the National Assembly has endorsed Resolution No 205/2025/QH15 on piloting the People's Procuracy's initiation of civil lawsuits. For cases that are highly complex, involve very huge damage, span multiple provinces or cities, affect national security or foreign affairs, or when considered necessary, the Supreme People's Procuracy may initiate lawsuits or conduct inspections, verifications, and evidence gathering before assigning the lower-level procuracy to initiate the lawsuits.
Overall, Resolution No. 205/2025/QH15 is a significant step towards reinforcing Vietnam's legal system and better protecting the rights of its citizens, particularly those in need.
The adoption of Resolution No. 205/2025/QH15 in Vietnam's National Assembly marks a crucial move in the integration of Artificial Intelligence (AI) and Policy-and-Legislation in shaping the country's politics, as the People's Procuracy is now authorized to leverage AI to initiate civil lawsuits to protect vulnerable groups and public interests. This progressive policy move is a key part of the country's General News agenda, aimed at strengthening the judicial system and ensuring rights and interests are safeguarded.
