Zhanat, Makashov's grieving son, describes his father as an amiable man, devoted to his land and animals. That fateful day, Makashov ventured out to the steppe to gather his livestock for vaccinations. Unfortunately, he stumbled upon a group of youths engaged in illegal mining along the way, leading to a heated argument. In the end, one of the miners pulled the trigger, ending Makashov's life, as claimed by his son, with an eyewitness confirming the account.
"I strongly believe it was a premeditated execution by a clandestine group. They were ravaging our lands, driving recklessly through our village, damaging infrastructure, and roads. My father was not well-liked by them, for he was a farmer here and had often admonished them for their destructive actions," laments Zhanat Makashov, the victim's son.
Initially, one suspect faced charges for the heinous crime, but the case was subsequently reclassified as "murder in self-defense," resulting in the alleged murderer's release.
"The crime falls under Article 99, punishable by 8 to 15 years, yet the perpetrator violated our rights by reclassifying the case to Article 102, carrying a mere two-year sentence," comments Zhanat Makashov. In this case, the suspect was granted freedom due to factors including a year of detention, according to Judge Abdykamalov of the Shet District Court.
Despite the family's protests, the local court's ruling was initially upheld. However, the appeals court accepted the case, finding numerous errors in the judicial process, causing the original decision to be overturned.
The proceedings also revealed flagrant breaches of due process, such as the lack of interpretation services for non-Kazakh speakers and misunderstandings between suspects and witnesses. The absence of a translator during lineups with Uskenbekov—a Kazakh speaker—and a non-Kazakh witness, added to the growing concerns regarding the investigation's integrity.
"At present, Uskenbekov is under preliminary investigation for parts 1 of Article 96 and 3 of Article 287. Makashov's appeals were examined during the preliminary investigation and included in the records as submitted," clarifies Nurlan Kaldybai, the prosecutor of the Karaganda regional prosecutor's office.

The suspect's legal counsel declined to comment on the matter, citing the confidentiality of the proceedings.
