Potential Delay in Cannabis Legalization Discussion
It seems that the planned legalization of cannabis, initially set for the start of the new year, might now be pushed back. The "traffic light" coalition in the German parliament revealed this information to Deutsche Presse-Agentur.
Initially, the plan was to pass the law in the Bundestag during the last week of the year, specifically between December 13 and 15. However, the Bundesrat might not have sufficient time to discuss the matter before the last Bundesrat session on December 15 as the deadlines are tight.
Although the regulation doesn't strictly require the Bundesrat's acceptance, it must still deliberate on the matter just like any other bill. The following Bundesrat meeting won't take place until February 2, 2024, after which the law could be implemented. A potential date for the implementation, as mentioned in certain circles, is April 1, 2024.
Controversial Topic
Cannabis legalization has become a hotly debated topic, with various groups expressing opposing viewpoints. Medical associations, police representatives, and the German Association of Judges are among those who have spoken out against the plan. However, addiction experts and reform-oriented lawyers argue for necessary decriminalization.
Current Status and Future Plans
As of now, adults over 18 can possess up to 25 grams of cannabis in public and up to 50 grams in their homes. They're also allowed to grow up to three female plants for personal use. Non-profit cannabis social clubs with up to 500 members are authorized to cultivate cannabis collectively, with members obtaining limited amounts per day. Advertising of recreational cannabis is banned under the Cannabis Act that came into effect on April 1, 2024.
The full regulation of cannabis sale is still pending due to EU Commission concerns about public monopolies. Nevertheless, cannabis clubs will remain the only legally authorized distribution points. Germany's commitment to EU law compliance, upcoming elections, and evolving coalition dynamics will likely influence the future of cannabis legalization in the country.
