Brussels expresses concerns over the amnesty law, and the Government assures them that it addresses all related inquiries.
The European Commission has immersed itself in a "shared procedure" regarding the controversial Spanish amnesty law, as it continues to engage in a constructive dialogue with the Spanish government about the matter. The Minister of the Presidency, Justice, and Relations with the Courts, Félix Bolaños, is leading the dialogue on behalf of the Spanish Government.
The European Commission has expressed concerns about the amnesty law and the General Council of the Judiciary (CGPJ), which has been expired for five years. Brussels considers the renewal of the CGPJ a "priority" due to its potential impact on the functioning of justice in Spain. The Commission has also raised questions about the amnesty law, and the Spanish government is responding to them in a transparent manner.
The Commission's evaluation of the amnesty law will be issued when the Spanish Cortes adopt a definitive text. In the meantime, the Commission has advised renewing the composition of the CGPJ first before initiating a reform process to advance towards a model more compatible with European standards.
The dialogue between the Commission and the Spanish government about the amnesty law began after the European Commission was informed of the text of the law. The Commission's position on the amnesty law has not changed since the first exchange with the Spanish Government.
The Minister, Félix Bolaños, previously stated that Brussels had "zero concern" about the amnesty law, but a spokesperson for the Executive later clarified that the Commission has not yet expressed any concern. However, Cuca Gamarra, the Secretary General, accused Bolaños of "lying" about the European Commission's position on the CGPJ issue.
The Commission's Secretary General, Didier Reynders, commented on the CGPJ issue in a report on the rule of law in 2022. Regarding the "Catalan issue," Reynders stated that it is an internal matter of Spain, which must be resolved within the framework of the Constitution.
Meanwhile, the PP leader has come under criticism for not carrying out an agreement on the renewal of the CGPJ and the draft law. The PP leader, according to Bolaños, could not withstand the pressure from the most ultra elements of his party regarding the renewal of the CGPJ. Gamarra also stated that Bolaños has been refuted by the European Commission for the second time about the CGPJ issue.
The European Commission has not explicitly identified the person who linked the Commission with concerns about the amnesty legislation in Spain and who has received assurances from the government that all concerns will be addressed transparently. Therefore, based on the available information, there is no direct identification of this person.
