Germany's controversial border policies are in the hot seat once again, with Juso-Chair, Philipp Türmer, sounding the alarm over Federal Chancellor Friedrich Merz's refusal to act on the Berlin Administrative Court's ruling. The court decision nullifies the rejections of asylum seekers at the border, as it violates the Dublin Regulation and EU law.

What's the state of play?

Three Somali individuals contested their rejection at a train station in Frankfurt an der Oder, claiming it was an infringement of their rights as asylum seekers under EU law. The Berlin Administrative Court agreed, deeming the rejections unlawful and urging the German government to process their claims properly instead of turning them away[1].

Juso-Chair's concerns and demands

Türmer, the head of the SPD youth organization, has slammed Interior Minister Alexander Dobrindt for defying the court ruling. He urged Merz to step in and force Dobrindt to respect the law, claiming it was unacceptable that the government continues to ignore EU law and promote an illegal directive to the federal police[1].

Time for a U-turn?

In Türmer's opinion, if Dobrindt fails to correct his course, Merz must intervene and put the federal policymakers back on the right track. He insists that there is no legal basis for rejecting asylum seekers at the border[1].

With mounting pressure on Merz to address the issue, it remains to be seen whether he will yield to public criticism and successfully challenge the hardline stance on immigration.
