Border controls under fire from Saarland refugee council
In a recent statement, Peter Nobert, representing the Saarland Refugee Council, has criticised the policy of the Federal Interior Minister, Alexander Dobrindt, for enforcing border controls that aim to reject refugees at the Saarland border. Nobert asserted that this policy violates the human right to asylum, requiring asylum applications to be accepted and examined in Germany.
The policy change, primarily targeting refugees, has been met with opposition from the Saarland Refugee Council. They demand an end to border controls and argue that the acceptance of asylum applications in Germany is a fundamental aspect of the human right to asylum. This stance contrasts with the Saarland SPD state government's support for Dobrindt's policy.
Nobert expressed concern that the Saarland SPD state government is supporting Dobrindt's border policy despite reservations. He also condemned the policy of isolation and rejection of refugees, stating that no one in Saarland can seriously want such border controls.
The Saarland Refugee Council further criticises the border controls for using 'racial profiling' criteria. They argue that this practice, if true, would be a clear violation of human rights.
Dobrindt's border controls and rejections follow the example of Orbán's anti-migration policy, raising concerns about the potential impact on the freedom of movement within the EU. The rejection of refugees at the border also violates European and international law, including the EU Asylum Procedures Directive and Dublin III Regulation.
The narrative of a 'national emergency' is being used to override European law, a practice that may not hold up in the European Court of Justice (ECJ). The Saarland Refugee Council has demanded an immediate end to border controls, echoing the headline in the BILD newspaper, 'Dobrindt orders: Asylum stop at all borders - IMMEDIATELY!'.
As the situation unfolds, it calls into question a central aspect of European policy and the principles of human rights, particularly the right to asylum. The Saarland Refugee Council's fight against Dobrindt's border policy serves as a reminder of the ongoing debate and the importance of upholding these principles.
