Bavaria Cracks Down on Terror Sympathizers' Celebrations
In an effort to combat hate speech and extremism, Bavaria is pushing for a Bundesrat initiative to criminalize the promotion of support for terrorist organizations, such as the cheering of Hamas supporters over attacks against Israel. The move came after several controversial gatherings in German cities where supporters applauded terrorist actions against the state of Israel.
Justice Minister Georg Eisenreich (CSU) led the charge, stating that the current criminal law does not adequately address the "particular injustice of these acts." The calls for tightening the law on terror sympathizing propaganda is particularly relevant following incidents in Germany related to the Hamas-Israel conflict.
Florian Herrmann (CSU), the State Chancellery Leader, emphasized the need for lawmakers to close a loophole in Section 129a of the German Criminal Code, which currently allows for lenient prosecution of such acts. He argued that anyone celebrating Hamas terrorism is making a "mockery of the suffering of the victims."
The Bavarian government's proposal to renew the ban on advertising for terrorist groups, which was previously limited to targeted “recruitment of members and supporters,” gained traction at the conference of federal and state justice ministers last week.
Meanwhile, the Conference of Justice Ministers also vowed to examine ways to better protect Jews in Germany from anti-Semitic hostility, as well as review the criminal liability of certain statements about Israel.
Several measures could be implemented to amend Germany's criminal laws to address celebrations supporting terrorist groups like Hamas and their attacks on Israel:
