Awarded VPO project in Pamplona involves "occurrences" for Acciona and Servinabar, according to a fresh report
In a recent development, the Office of Good Practices and Anti-corruption of Navarre (OANA) has determined irregularities in the tender process for the construction of 62 VPO (Public Housing Units) in Erripagña, Pamplona. The contract was awarded to UTE Acciona Servinabar.
The OANA's report suggests that the award process was marred by several incidents, including the absence of minutes, failure to meet publicity requirements, and the publication of the award out of time. Furthermore, the absence of quarterly publication in one of the 11 files analyzed was detected.
Nasuvinsa, the Navarre Public Works Corporation, under the direction of José Mariá Aierdi, is believed to have ignored public procurement principles and violated the Foral Law of Public Contracts. The corporation allegedly introduced changes in the matter of minimum furniture, installation of kitchens, partitions, and CCTV cameras. However, the justification for these changes could not be verified due to the lack of a dated document of architectural requirements.
Planned increases were not included in the calculation of the estimated value, and acts of opening and evaluation of the offers presented were not provided. The report also states that minutes of admission of participants are missing, and it was not possible to verify the constitution of the 30,000 euro bank guarantee required in the tender documents.
Servinabar, a company believed to be a pathway for channeling profits in the Santos Cerdán case, is mentioned in the report. It is estimated that Servinabar, in conjunction with Acciona, secured seven contracts worth approximately 8.6 million euros in Navarre.
José María Aierdi, the director of Nasuvinsa, disputes a large part of the OANA's report, claiming that some statements are untrue and denying any favoritism towards parties or companies. The UCO has delivered a document to the Supreme Court, accrediting that Cerdán bought 45% of Servinabar for 6,000 euros.
It is important to note that the report on the award of the VPO was limited to applying public procurement regulations, without constituting an audit or implying a global opinion on the legality of the awards. The auditor emphasizes that other legal or technical aspects could give rise to different assessments, and stresses that the responsibility for the sufficiency of the procedures lies exclusively with the Public Enterprise Corporation of Navarre (CPEN).
The Office of Good Practices also detected irregularities, adding to the growing concerns about the transparency and fairness of public works tenders in Navarre. The matter is currently under investigation, and further developments are expected.
