According to a recent expert opinion by lawyer Butz Peters, there's a possibility that the Corona Investigation Committee established by the Hessian state parliament could halt its operations due to a legal dispute by the AfD opposition at the State Court of Justice. However, this halt cannot be decided against the vote of one-fifth (27 votes) of the 133 members of the parliament.

Established in June 2024 at the initiative of the AfD, the parliament had earlier commissioned several expert opinions regarding the AfD's application containing 43 questions due to constitutional concerns. Following the reading of these opinions, the four factions of CDU, SPD, Greens, and FDP narrowed down the investigation mandate to merely seven questions deemed constitutional.

The AfD faction filed a constitutional complaint with the Hessian State Court of Justice at the end of last year, demanding implementation of its original 43 questions within the Corona Investigation Committee. The opposition faction also seeks changes in the committee's composition.

The investigation committee is presently deliberating whether to hold off the committee's work until a verdict from the State Court of Justice. In February 2025, the committee passed a resolution to procure an expert opinion on this matter, securing the votes of CDU, SPD, and Greens, while the FDP chose to abstain, and AfD voted against.
