Germany's Chancellor, Friedrich Merz (CDU), continues to endorse the rejection of asylum seekers at the border, disregarding a court ruling in a specific case that deemed such rejections as illegal. The coalition partner SPD isn't objecting but advises considering the Berlin court's decision carefully.

Merz, talking at the communal congress of the German Association of Towns and Municipalities in Berlin, admitted that the court's decision narrowed their room for maneuver slightly. However, he asserted that they still have the ability to carry out rejections.

Germany will implement these rejections, Merz emphasized, within the framework of existing European law. He reiterated that this is essential for maintaining public safety and order in their country and to prevent cities and municipalities from being overwhelmed.

The court's decision has profound consequences. However, it’s not definitive, as stated by SPD parliamentary group leader Matthias Miersch. More analysis is needed to determine the effect on future border control proceedings.

Federal Minister of Justice, Stefanie Hubig (SPD), stated that the government will comply with court decisions. The three applicants will now experience a procedure in Germany according to the so-called Dublin rules.

Merz underscored that border controls will continue until the situation at Europe's external borders significantly improves, aided by new common European rules. Internal border controls were ordered by Federal Minister of the Interior, Alexander Dobrindt (CSU), on May 7, along with rejections at the border, however, with exceptions for specific cases such as children and pregnant women.

On Monday, the Berlin Administrative Court deemed three Somalis' rejection at a border control in Frankfurt (Oder) as unlawful, as the EU state responsible for their asylum application hadn't been clarified. Despite this ruling, Dobrindt asserted that their rejection strategy aligns with the law.

However, academic Winfried Kluth, from Martin Luther University Halle-Wittenberg, cautioned that inferences from individual municipalities to the whole of Germany are questionable. The Administrative Court of Berlin noted legal hurdles and mentioned that an appeal against the decision to the higher instance, the Higher Administrative Court of Berlin-Brandenburg, is not possible under current law.

The court spokeswoman explained that an appeal is not provided in the Asylum Act since urgent court proceedings already deal more deeply with the case. A substantive review will only occur if the court determines that this is necessary.

After the court decision, Dobrindt declared his intention to maintain the practice at the border and seek a main proceeding. The Federal Ministry of the Interior is not aware of any other pending asylum seeker proceedings, according to a spokesman.

Justice Minister Hubig admitted that the court has not yet definitively clarified whether asylum seeker rejections at the internal borders are compatible with EU law. The final decision rests with the European Court of Justice.

The Green faction plans to question Dobrindt about the legal foundations and consequences of controls and rejections during the Interior Committee meeting on Wednesday. The faction believes that such decisions with disregard for the judiciary should not set a precedent.
