Arcuri, former partner of Juana Rivas, following the initial court hearing of the trial: "All accusations were entirely baseless"
Juana Rivas, a Spanish mother, has handed over her younger son to his father, Francesco Arcuri, following a court order on July 25. This marks the end of a seven-month stint in Spain for Rivas, who was previously convicted of possible child abduction in 2018 and partially pardoned in 2021 by the Government.
The Rivas-Arcuri case, which has been ongoing for more than nine years, took another turn as the court will appoint a legal representative or "curatore speciale" for Arcuri's younger son in this criminal proceeding. The defense, led by Arcuri's lawyer, Enrico Marcello, has requested this appointment due to alleged neglect of duties by the current legal guardian designated in the civil custody procedure.
Arcuri, in a statement, claimed that "very serious things" were done to his child during the time the child was in Spain. However, he did not provide specific details, citing the sensitive nature of the information. He also mentioned that his children have told him different things, but refrained from elaborating.
Italian authorities have been investigating allegations of physical and psychological abuse against Arcuri. However, Arcuri has denied all such allegations. The trial against him will resume on October 23, with the hearing focusing on the admission of evidence.
Rivas, on the other hand, will testify on October 30 regarding the child abduction case. In the summer of 2017, Rivas was in hiding with her children for a month to avoid handing them over to their father, arguing that she was protecting them from the alleged abuse by Arcuri. However, the Spanish justice system rejected her last appeal to delay the handover on July 25.
Fabio Canna, Rivas's lawyer in Cagliari, stated that they did not request the appointment of a legal guardian. Contrarily, the Public Prosecutor, with the support of Arcuri's defense, has requested this appointment. The hearing on October 23 was postponed to resolve procedural issues related to the custody of the younger son.
The Rivas-Arcuri case continues to unfold, with the trial resuming in October and Rivas set to testify on the child abduction case. The appointment of a legal guardian for Arcuri's younger son remains a significant development in this long-standing legal battle.
