Appellate Court Reverses Federal High Court's Decision on Kano Local Government Election

The Court of Appeal in Abuja has rescinded a ruling by the Federal High Court in Kano that nullified the structure of the Kano State Independent Electoral Commission (KASIEC) and the local government election held by the commission on October 26, 2024.

In a unanimous decision, a panel headed by Justice Biobele Georgewill, comprising three judges, ruled that the lower court lacked the authority to hear cases pertaining to the makeup of state electoral bodies and the qualifications of their members. The panel declared that the High Court of Kano State shouldHandle such matters instead.

Our reporting reveals that the Court of Appeal upheld the three appeals lodged by the Kano State Attorney General, the Kano State House of Assembly, and KASIEC, thereby dismissing cases presented to the Federal High Court due to jurisdictional limitations.

Additionally, the Court of Appeal annulled another ruling from the Federal High Court in Kano, which had disallowed the candidate list submitted to KASIEC by the Musa Kwakwanso faction of the New Nigeria People's Party (NNPP) for the recent local government election in Kano State. The court highlighted that matters concerning party leadership and the nomination of candidates are not open for judicial review.

It is worth noting that the High Court of Kano State is the apprehensive judicial body in adjudicating matters related to the composition of Kano’s state electoral bodies and the qualifications of their members. The judges have established that it is the proper court with the requisite authority to handle these issues[1][2][5].
