Appeal judgement in the high-profile Pocher case results in victory for defendant Becker

In a legal proceeding with the case number VI ZR 393/23, former tennis star Boris Becker has emerged victorious in his lawsuit against comedian Oliver Pocher. The Higher Regional Court in Karlsruhe confirmed a final and binding judgment in November 2023, not allowing Pocher to distribute controversial image sequences from the television contribution "Pocher - dangerously honest."

The dispute arose from a fundraising appeal in Pocher's show, where a "Make Boris rich again" campaign was launched. Unbeknownst to Becker, he received a three-digit euro amount, hidden in a supposed fashion prize. This action was deemed inappropriate by the court.

Following the initial ruling, Pocher was required to delete relevant film clips, published within his own online presence. However, Pocher attempted to appeal the decision to the Federal Court of Justice (BGH) in Karlsruhe, but his appeal against the refusal of admission was rejected.

Pocher's lawyer, Patricia Cronemeyer, considers the rejection of the non-admission appeal as unacceptable. Cronemeyer has expressed her intention to file a constitutional complaint, believing the decision to violate constitutional principles.

It is worth noting that Becker, a three-time Wimbledon champion, was not present in court at the time of the final decision. His lawyer, Samy Hammad, has confirmed that the legal remedy in this matter is now exhausted.

The legal proceedings have come to a close, with Becker winning the case and the court upholding its decision not to allow Pocher to distribute the controversial image sequences. The case serves as a reminder of the importance of respecting individuals' rights and the consequences that can arise from violating those rights.
