Alleged loss in another clash at the left-wing tavern?
The long-standing eviction dispute at the 'Kadterschmiede' bar in Berlin-Friedrichshain's Rigaer Street is set to continue, with a decision expected on October 15. The courts aim to decide in October on the current case of the 'Kadterschmiede' and the eviction lawsuits against house residents.
The 'Kadterschmiede,' an illegal left-wing autonomous bar, has been a subject of numerous legal disputes for years. The property company, Lafone Investments Limited, based in England, is attempting to evict the bar from the side wing of the partly occupied 'Rigaer 94' building complex.
The current case has Judge Sebastian Pörschke stating that eviction claims could be justified, but requires the lawsuit to be declared admissible. This decision was later confirmed by the higher instance, the Berlin Court of Appeals. However, most of the landlord's eviction lawsuits have been dismissed as inadmissible on formal grounds, resulting in no substantive examination of the British company's possible claims.
In an earlier proceeding, the Regional Court dismissed the landlord's lawsuit as inadmissible, mainly due to the insufficient power of attorney of the lawyers. The judge in the current oral hearing has expressed doubts about the admissibility of the landlord's renewed eviction lawsuit. He will announce his decision at the Regional Court on October 8.
The operators of the bar have been using the premises without a lease since late 2013. About three weeks ago, a large police operation with around 200 officers, a battering ram, and other technical equipment was conducted in the barricaded building. The police search was requested by the landlord in view of the court proceedings.
The left-wing scene in Berlin has repeatedly resisted evictions from the 'Rigaer 94' building complex. There is a dispute as to whether the property company is authorized to act and institute legal proceedings due to its administrative seat in England. A decision by the Court of Appeals from summer 2024 states that the company has its administrative seat in England and is therefore authorized to act and institute legal proceedings.
The plaintiff demands a monthly compensation of 650 euros from the operators. As the decision date approaches, the fate of the 'Kadterschmiede' remains uncertain, adding another chapter to the ongoing saga of the 'Rigaer 94' building complex. The final decision regarding the eviction lawsuits against house residents is expected on October 15.
