In a heated campaign ahead of the November 8 midterms, Californians will decide whether to legalize retail and online sports betting, a move predicted to be the costliest initiative in U.S. history. With negative advertising and conflicting messages dominating the airwaves, it remains uncertain if the proposed measures will pass.

In the final 100 days before the elections, campaigns have grown increasingly vitriolic, as opponents harshly critique the proposed initiatives with statistics, comments, and other messages. Last week alone, multiple "No" campaigns accused various groups of opposing a measure backed by commercial operators, painting a confusing picture for voters.

However, a recent endorsement from Major League Baseball may prove pivotal for one of the California proposals, potentially swaying baseball fans in support of the commercial initiative. The gaming campaigns are now reaching a boiling point with five other initiatives, including reproductive freedom, greenhouse gas emissions, and flavored tobacco, competing for attention.

As the election gets closer, both sides will likely ramp up their advertising and marketing spending to win over voters. Gayle Collins, an experienced political strategist, says a significant challenge for those attacking the issue is that sports betting may not be a top priority for voters. Tribes vs. Tribes vs. Corporate America

The main point of contention revolves around whether voters will pass either Proposition 26 or Proposition 27. The former is a tribal-backed initiative that would introduce in-person sports betting, while the latter, supported by tech giants and sports betting operators, aims to legalize online sports betting in a state expected to generate unprecedented revenue from digital wagering.

Earlier this year, a coalition of tribes succeeded in getting Proposition 26 on the November 2022 ballot. They vowed to continue protecting California and its gaming interests should the measure pass. On the other side, major corporations like Bally's, BetMGM, DraftKings, Fanatics, FanDuel, PENN Entertainment/Barstool Sportsbook, and WynnBET have banded together to push for more comprehensive legalization.

Recent weeks have seen a shift in the campaign landscape, making it more challenging to discern which measures to support. With multiple tribal groups now aligned with the operators, confusion surrounds the initiatives, thus potentially muddling voter decisions.

Targeting the Right Audience

Veteran political consultant Brendan Bussmann emphasizes that campaigns must differentiate themselves and understand their target audience to break through the noise and win voter favor. However, the convoluted messaging surrounding the measures may make it difficult for voters to make informed decisions.

At the heart of the issue is the question of which proposition has the best chance of passing. Currently, it is uncertain whether Proposition 27 will succeed, given weak support for it and the ongoing controversy it has sparked. If Proposition 27 fails, it would mark the second time in a year that DraftKings and FanDuel have invested heavily in an initiative campaign without success, having previously abandoned an effort in Florida.

In contrast, the California Solutions for Homelessness and Mental Health Act campaign has yet to share any recent polling data, adding to the uncertainty surrounding these proposals.

The Road Ahead

Key to success in the campaigns is not just the amount of money spent, which has reached unprecedented levels, but also how that money is spent. Strategies such as micro-targeting, utilizing digital and mass media advertising, and harnessing the power of over-the-top (OTT) advertising could be crucial in reaching and persuading the right voters.

Ultimately, the success of the initiatives may depend on how well campaigns can cut through the noise and effectively communicate their respective messages to voters.
