The AfD is in a bind as they attempt to oust 22-year-old Daniel Halemba from their ranks in Lower Franconia. Halemba, a state parliament member, is under investigation for misconduct related to two party membership applications and faces charges for incitement and the use of Nazi symbols by the public prosecutor's office in Würzburg.

Reportedly, the applicants for party membership might have resided elsewhere, making the admissions unlawful. Subsequently, Halemba was elected by a slim margin to first place in the relevant party branch, though the extent to which the new members influenced this outcome remains unclear. The Federal Executive Board believes the membership admissions breached the party's articles of association.

Halemba, however, has chosen to exclude himself from leadership roles within the party but continues his membership of the state parliament and the parliamentary group. AfD parliamentary group leader Katrin Ebner-Steiner claimed that Halemba could still participate as a member within the group, though further clarification on the matter remains pending.
