Accused individual, René Benko, remains jailed while awaiting trial proceedings
René Benko, the former Austrian real estate tycoon, remains in pre-trial detention ahead of his criminal trial. The Vienna Regional Court has provisionally extended his detention until early October, as reported by various sources. 1
Benko's trial date has not been set yet. The first indictment against him accused him of hiding assets to the detriment of creditors during his insolvency as a sole proprietor. This indictment was brought in July 2022. 2
The penalty range for the charges against Benko is one to ten years imprisonment.
Benko built a complex network of companies during the low-interest phase. His group, Signa, invested in well-known properties and companies, including the Hamburg Elbtower, the Galeria department store group, and the luxury department store KaDeWe. 3
The downfall of Signa was attributed to internal corporate problems, rising interest rates, energy prices, and construction costs.
The WKStA has completed a preliminary report on another procedural strand for René Benko. This investigation also involves other Signa executives. 4
A date for the trial has not yet been set. However, the trial is expected to take place in Innsbruck, Benko's hometown.
The Public Prosecutor’s Office for Economic Affairs and Corruption (WKStA) has transmitted a new "project report" or preliminary prosecution file to higher authorities, indicating fresh lines of investigation and that additional charges or indictments are being prepared against Benko in the wide-ranging Signa affair. 1
An indictment by the WKStA alleging fraudulent bankruptcy against Benko has been reported as final by prosecutorial authorities in Innsbruck, signalling formal criminal charges that will be pursued in court. 4
The transmission of project reports and further investigative files to higher authorities typically precedes additional indictments or formal expansion of charges, so more charges or co-defendants could emerge as the WKStA pursues the case. 1
René Benko has been in custody for over six months.
The investigation includes suspicion of fraud and misappropriation. A decision on a possible second indictment against Benko lies with higher judicial authorities.
